Gedling neighbourhood specials policing team seized an E-Scooter while carrying out patrols in Gedling last night.
Illegal Use of E-Scooters and Gopeds.
These conveyances go by many different names, E-Scooters, GoPeds, Segways, City Bugs, Hoverboards are examples of a few.
All have one thing in common they are either propelled by electric motor or combustion engine and do not have pedals as their primary source of propulsion.
As such unless they are being used under the Nottingham City Trial they are illegal to use on public roads or other public areas.
Both E-Scooters and Goped are mechanically propelled vehicles and have been identified by the courts as “Motor Vehicles”, meaning they are governed by the Road Traffic Regulation Act 1984 and the Road Traffic Act 1988.
• Riders must have a valid driving licence
• Riders must have a valid insurance policy providing at least third party cover
• Vehicle must comply with regulations around construction and use.
• Drink and drug driving legislation can be applied. Where riders are suspected to be under the influence of alcohol or drugs, either committed moving traffic offence or involved in RTC , preliminary requirements of breath test or drug wipe can be made.
• Vehicle can be seized under Section 165 Road Traffic Act 1988 where a constable has reasonable grounds to believe a motor vehicle is being driven without a licence and/or without insurance.
• Rider can be warned under Sec 59 Police Reform Act 2002 where a constable has reasonable grounds for believing that a motor vehicle is being used in a manner that contravenes Section 3 (careless and inconsiderate driving) and Section 34 (off road driving) Road Traffic Act 1988 and is causing, or likely to cause, alarm, distress or annoyance to members of the public. Where a warning has been previously given and where rider continues to drive in such a manner as described above, then a power to seize is available under Sec 59.
Nottingham City E-Scooter Trial
Nottingham City Council is taking part in a national trial which has seen more than 200 E-Scooters available within the city area for short and long term hire.
The E-Scooters are being provided by WIND and only these E-Scooters are legal to ride during this trial.
These E-Scooters are easily identifiable as being bright yellow and displaying the company logo.
The rider of this E-Scooter was reported for the offences and will receive penalty points on their Driving Licence as well as a fine.
The current Endorsable fixed penalties for the below driving offences are:
 No insurance = 6 points and £300 fine
 No Driving licence = 3 points and £100 fine.
