Police response to attempted theft at Rushcliffe building site

Police officers from response and neighbourhood policing teams attended an attempted theft at a building site in Rushcliffe.

Police said access was gained by damaging locks and driving on an access track which is not a public road. Officers searched a large area and checked that plant machinery had not been interfered with.

A spokesperson added:

‘If you see offences or suspicious behaviour in our rural areas, then please report them as soon as possible to allow officers to respond appropriately to try to identify and if necessary, detain offenders at the earliest opportunity. Giving precise locations, times, dates and days of the week also allows our analysts to map offences, this in turn gives officers from the teams tasked with pro-active and protective activities to prevent offences or apprehend offenders a chance to plan operations to target nuisance or dangerous behaviour.

Nuisance Driving and trespass on land.

There are a number of civil and criminal offences related to accessing land which is not a public area, today officers have been investigating nuisance off road motorcycles and attempt theft from a building site.

It is an offence under section 34 of the Road Traffic Act 1988 to drive a mechanically propelled vehicle elsewhere than on a road. This includes petrol and electric motorcycles they cannot legally be ridden on Footpaths, Bridleways and Restricted Byways.

They can only be ridden on a Road or Byway open to all traffic if they comply with the road vehicle construction and use regulations. They must be registered with the DVLA, display a vehicle registration mark and pass an MOT.

To ride off road you must have the landowners permission. This means that you might see vehicles used by rural businesses, local land or property owners or the emergency services on land where other vehicles are prohibited.

It is up to the driver or rider to check they can legally access a highway or route.

Vehicles which do not have registration, vehicle excise licences and insurance are liable for seizure, vehicles ridden or driven off road can be issued with a section 59 notice meaning even if it is road legal it could be seized in future if the vehicle or the driver are found to be committing the same offence within 12 months.
