Man in court after breaching order banning him from ASDA store

A man has been fined in court after breaching a Criminal Behaviour Order which banned him from parts of Hyson Green.

James Livingstone, 40, of no fixed address, was made the subject of a Criminal Behaviour Order (CBO) by Nottingham Magistrates’ Court in November 2023.

This order followed reports Livingstone had been causing distress to members of the public by persistently begging and refusing to move on after repeated requests by shop staff, including at Asda Hyson Green.

Under the terms of the order, Livingstone was strictly prohibited from remaining in any shop when requested to leave by a member of staff from the shop.

He was also ordered:

  • Not to enter any area with the boundaries of a marked exclusion area, including Asda Hyson Green
  • Not to enter any retail premises of which he has received a banning letter
  • Not to beg in a public place

Despite the order being in place, on Saturday 20 April, he was spotted at Asda Hyson Green.

Police were called and Livingstone was arrested minutes later.

Appearing at Nottingham Magistrates’ Court on Monday 22 April, he admitted breaching a Criminal Behaviour Order and fined £50.

Inspector Liz Gaskin, of the City Central neighbourhood policing team, said:

“Criminal Behaviour Orders give us the opportunity to support offenders while preventing further offences being committed.

“We want Nottingham to be a place that people enjoy visiting and this is just one of many ways we can ensure our communities are kept safe.

“It is disappointing that Livingstone has breached his order and I hope he will now engage with support services so that he can access the help and assistance he needs.”
