Flawforth Lane: Parcel of land to be sold to developer for drainage outfall

Vistry Homes, the developer behind the nearby Edwalton Fields project of approximately 950 homes, has identified the land as critical to their drainage system.

Nottinghamshire County Council has moved to approve the sale of a 28 square metre parcel of land off Flawforth Lane in Edwalton.

 

This decision is outlined in a report to the Cabinet Member for Economic Development and Asset Management Committee.

The Land’s History and Context

The small plot of land in question is part of a larger area acquired by the Council in July 1984, reportedly for highway improvement purposes. Positioned on a bend of Flawforth Lane, it has remained unused for decades. However, its strategic location has recently attracted interest due to its potential role in addressing modern drainage requirements.

An existing surface water outfall on Flawforth Lane was found to be situated on unregistered land, creating legal and logistical challenges following changes in legislation. To comply, Vistry sought an alternative, registered site for relocating the outfall, leading them to approach the Council.

Initially, the company proposed an easement to discharge surface water from their development via the Council-owned land into a nearby watercourse. However, risk assessments highlighted potential liabilities for the Council, including future flooding issues downstream. To mitigate these risks, the Council has opted to sell the land outright rather than granting an easement.

As part of their preparation, Vistry commissioned micro-drainage assessments, demonstrating that the proposed drainage system meets stringent flood risk management criteria. Severn Trent Water, the region’s water authority, has also approved the design, adding a layer of assurance.

The sale will provide the Council with a capital receipt, contributing to its financial strategy under the capital receipts policy. The purchaser, Vistry Homes, will cover all legal and professional costs associated with the transaction. Additionally, the Council has safeguarded its interests by retaining the right to reacquire the land at a nominal cost should it be required for future highway development.

The proposal has undergone consultations with relevant stakeholders, including Highways Development Control, who raised no objections to the disposal.
