Newark and Sherwood District Council have approved tougher fixed penalties for fly-tipping and waste-related offences as part of its ongoing commitment to keeping the district clean and safe for residents, businesses and visitors.
The District Council has approved an increase in the Fixed Penalty Notice (FPN) for fly-tipping from £400 to £1,000. In addition, a new £400 household waste duty of care penalty has been introduced for residents who fail to take reasonable steps to ensure their waste is passed to an authorised person for disposal.
The changes will provide the District Council with stronger enforcement powers to deter irresponsible behaviour that harms local communities and the environment.
Councillor Paul Taylor, Portfolio Holder for Public Protection and Community Relations, said: “Fly-tipping has a real impact on our communities. It damages the environment, costs taxpayers money to clear up and affects how people feel about the places where they live and work.
“These changes send a clear message that environmental crime will not be tolerated in Newark and Sherwood. By increasing the penalties available for the most serious offences and introducing a separate offence for householders who fail in their duty of care, we are strengthening our ability to tackle waste crime and hold people accountable for their actions.
“We will continue to take a balanced approach, using education and engagement wherever possible, but we will not hesitate to take enforcement action against those who deliberately ignore the rules.
“We also want to remind residents that there are simple and affordable ways to dispose of waste correctly. Our bulky waste collection service provides a convenient, low-cost option for disposing of larger household items safely and legally. By taking a few simple checks before handing waste to someone else, residents can help protect our environment and avoid becoming victims of rogue waste carriers.”
The District Council issued 226 FPNs during 2025/26, including 154 for fly-tipping offences. The new tariff structure is designed to provide a more proportionate enforcement framework, reserving the highest penalty for those responsible for illegally depositing waste, while introducing a lower-level penalty for householders whose waste is later found to have been fly-tipped because they failed to check that it was being disposed of legally.
Income generated through Fixed Penalty Notices is ringfenced and reinvested into environmental enforcement, education and prevention initiatives, helping the Council to tackle environmental crime and anti-social behaviour across the district.
The revised Fixed Penalty Notice tariffs will be published on the Council’s website and will come into effect from October 2026.
